The Indiana Medical Licensing Board has
fined and fined an Indianapolis doctor who last year made a public statement to
abort a 10-year-old Ohio rape victim after finding that the statement violated

When Bernard spoke to the Indianapolis Star about the girl's condition during the summer without the girl's or her guardian's permission and without using her name, the complaint claims that she violated patient privacy regulations.
A few days after the U.S. Supreme Court overturned Roe v. Wade and ended federal abortion laws, it became clear why the Ohio girl had gone to Indiana for treatment, which helped bring Bernard into the nationwide debate about abortion rights.
At the time of the Roe decision, Ohio generally banned abortions after detecting heart activity, which was around the sixth week of pregnancy. Bernard told CNN last year that he aborted the girl in late June and that she had gone to Indiana for surgery. According to Bernard, the girl was six weeks and three days pregnant.
In Indiana, where the operation was performed, abortion was legal up to 20 weeks after conception. The state has since passed laws that prohibit abortion at all stages of pregnancy, with a few exceptions, including rape, incest, saving a woman's life, preventing serious harm to her health, and fatal fetal abnormalities.
The situation immediately came to the fore of the post-Roe abortion rights debate. Before the man was accused of raping the girl and an Ohio detective testified that the girl had an abortion in Indianapolis, many Republican leaders and the media initially expressed doubt about Bernard's claims. On Thursday, the head of the Indiana Medical Licensing Board voted in favor of punishing Bernard.
Board chairman Dr. John Strobel stated during the discussion, "The reason I recommend the letter of reprimand is that I don't think she expected it to go viral."
