A distraught husband, who was seriously injured in the collision that claimed his new wife's life just seconds after they drove away from their wedding in a golf cart, is suing both the alleged drunk driver who hit them and nearby bars believed to be that he had given her an "excessive" drink.

 

Aric Hutchinson, 36, filed a manslaughter lawsuit Wednesday in the ninth judicial district of Charleston County, South Carolina. He claimed that 25-year-old Jamie Komoroski was grossly negligent and reckless on April 28, which was then supposed to be the happiest day in the lives of Samantha Miller and her new husband.

The day was perfect and the wedding went better than either of them could have imagined, the trial began by sharing a photo of the "madly in love" leaving their wedding party as newlyweds without knowing the nightmare that awaited them. Authorities say Komoroski got behind the wheel in Folly Beach with a 0.261 BAC - more than three times the legal limit - and accelerated before hitting a golf cart in a "drunk haze".

 

But according to the petition, "[what] began and should remain, the happiest day of Sam and Aric's lives ended in a horrific and incredibly devastating, but entirely preventable tragedy." Hutchinson's Utah brother-in-law Benjamin Garrett, his wife Alexis, and their 17-year-old son Brogan joined the case as plaintiffs. According to the lawsuit, Benjamin Garrett operated a golf cart while his son sat next to him.

 

“Despite living on James Island, Jamie Komoroski made the mistake of driving east on East Ashley Avenue away from her home while drunk. The plaintiffs argued that the numerous facilities that handled the "noticeably and clearly intoxicated" Komoroski were equally liable for negligence and wrongful death.

 

All of the defendants, including The Crab Shack, Taco Boy, The Drop In, Snapper Jacks, El Gallo and 1-20 John or Jane Does, are charged with wrongful death and involuntary mental suffering. "Bar hopping" Jamie Komoroski is being sued separately for gross negligence and recklessness.

 

In addition, the plaintiffs accuse the bars of negligent, grossly negligent, and/or reckless hiring, supervision, training, and retention. Komoroski's employment at Taco Boy, one of the bars named in the case, was disclosed in the lawsuit.

 

The boss of Komoroski was charged with "organising, organising and supervising an employee function, knowing that an excessive amount of alcoholic beverages would be purchased, served, and consumed by employees attending the event," at one point in the complaint." Charleston attorneys Brian Mickelsen and Daniel Dalton have filed suit in multiple cases.
